Rule 24
Procedures to be adopted during inspection, investigation or search
: (1) The inspection officer: When entering the place of business while starting inspection, investigation or search according to the Act and this regulation, the manufacturer, distributor, Should be given to seller or service provider.
(2) After being notified as per sub-rule (1), the inspection officer shall enter the industry, warehouse, business premises, house compound, means of transport or any other place related to the goods or services to be inspected, examined or searched or with the person concerned. He can ask for any documents or details related to that.
(3) Before conducting a search according to sub-rule (2), the inspecting officer shall conduct a physical search of the relevant manufacturer, distributor, seller or service provider or the owner of the industry, warehouse, commercial premises, house compound, means of transport or his representative involved in the work of the search. A bond must be prepared in the format as per Schedule-4 of the transaction after entering the place of investigation and completing the search.
(4) The inspection officer may prepare a test list of goods or services as per Schedule-5 for the purpose of inspection or inspection during inspection, investigation or search according to sub-rule (1) and may also collect samples for testing such goods or services.
(5) The inspection officer shall also use the monitoring and inspection form as per Schedule-1 while inspecting, examining or searching the premises.
(6) According to sub-rule (1), if someone obstructs the work of inspection, investigation or search, the inspection officer shall give a notice to the person obstructing such obstruction to leave the premises. If they do not move when given such notice or obstruct the entry, the inspection officer may use force as necessary to remove the person obstructing such obstruction or enter any window, door, hatch or break in the relevant building and conduct inspection, investigation or search.
(7) According to sub-rule (1), if any item is recovered from that place during inspection, investigation or search, the description of such item or its sample shall be mentioned and the owner of the item and, if available, in the name of the representative of the local level or any government employee and local person in the format as per schedule-6. A warrant must be prepared. A copy of the warrant prepared in that way should be given to the concerned person.
(8) If no person is found to be a witness in the warrant prepared according to sub-rule (7), or if the persons present refuse to be witnesses, the inspecting officer shall sign the same in the bond and keep a copy with him.
(9) If a person's body is to be searched, it can also be taken while taking the food search, and if the person to be searched is a woman, the body search should be taken by a female employee.
(10) When inspecting, investigating or searching food, it should be done during the time between sunrise and sunset as much as possible according to the nature of the business.
(11) When inspecting, investigating or searching, it should be done in such a way that no one's private or public property is damaged as much as possible.
(12) The inspecting officer shall keep the record of inspection, examination or search conducted in accordance with the Act and these regulations in the format as per Schedule-7.
